The Consumer Product Safety Commission (CPSC) is an independent government agency which was formed under the Consumer Product Safety Act to protect citizens against unreasonable risk of injury when using consumer products. Throughout the year, it issues warnings and recalls of certain products which have been deemed to have safety hazards. These products range from food, electronics, house wares, and appliances to auto parts, children's toys and gear, jewelry, cosmetics, construction equipment, medical devices, automobiles, and more.
In a recent release, the CPSC issued a statement that 223,000 Peg Perego strollers have been recalled because of a risk of child entrapment and strangulation. Apparently, a child's head can get trapped between the stroller seat and its tray. A 6-month child died from strangulation in this manner. Another 7-month nearly died in the same way. The report from the CPSC stated that children younger than one year who are placed in the stroller without being harnessed are the most susceptible to this risk when their head and neck can become entrapped by the tray. The recall involves two versions of the stroller which were manufactured prior to a new standard which called for a larger opening to prevent the strangulation hazard.
Compensation for Defective Product Injuries
Where a consumer product has resulted in injuries to someone using it in the manner for which it was intended, the injured person may have grounds for a personal injury claim against the manufacturer. Products can be defective in their design, their manufacture, or in their marketing, as in cases of poor or inadequate labels, warnings, or instructions.
