IDOT Worker Settles Personal Injury Lawsuit

In the state of Illinois, an Illinois Department of Transportation (IDOT) employee recently settled his personal injury lawsuit for an amount that is undisclosed.  The settlement will allow involved parties to avert a jury trial that had been set to take place in Madison County on December 8th.

In August 2007, Troy Turner filed his personal injury lawsuit, which alleged that he had sustained "diverse and numerous injuries" on October 18, 2005.  Turner alleged that he was injured after Jeongyun Huh crashed his motor vehicle into the rear of the IDOT vehicle Turner was operating on Interstate 55.

Troy Turner has been operating an IDOT safety vehicle and was providing security for other IDOT employees who were performing roadside maintenance when the accident happened.  Turner claims that Huh was negligent by failing to see and observe his IDOT vehicle when it should have been observed.  He claims that Hug carelessly disregarded the IDOT safety vehicle and also fell asleep while driving his car.

After the accident, Turner decided to file the lawsuit because he said that the accident caused him injuries that led to pain and suffering, medical expenses and lost wages. 

The case was expected to go to trial, as Huh felt the accident was not his fault.  Huh argued that Turner failed to mark lane closure in advance of the road work and also that Turner negligently stopped his IDOT vehicle in traffic lanes on a high speed highway. 

However, a settlement was reached between both parties, and Madison County Associate Judge Ralph Mendelsohn signed off on the settlement and ordered each party to bear their own costs.

Mr. Turner was originally seeking damages in excess of $50,000, but less than $75,000.
