An independent contractor working with a relative doing tree trimming service died recently after falling from a tree he was working in. The victim, 54-year-old C.M. from Dothan, was working at a residence in Columbus when the accident happened. He was cutting sections of a tall tree in the back yard of a home that afternoon when he fell about 100 feet to the ground. The man had reportedly just cut a section of the tree measuring three feet when his safety harness broke. Paramedics were called to the scene where C.M. lay on the ground and was unresponsive. He was rushed to the hospital where he was pronounced dead at about 3:00 in the afternoon. The coroner's report stated that the man died of blunt force trauma caused by the 100-foot fall to the ground. Reports do not indicate if the safety strap he was wearing had been cut or any specific failure that caused the harness to break. You may have a wrongful death case if your spouse, child, parent or other family member died in an accident that resulted from another party's recklessness. Consult with a personal injury lawyer about your legal rights.
Pursuing a Wrongful Death Suit
The state of Alabama has specific statutes regarding the death of a loved one in a case involving negligence. The family of the deceased may seek punitive damages rather than simply attempting to receive compensation for their loss. Instead of pursuing compensation for the cost of medical expenses, funeral expenses, loss of income, pain, anguish and others, the person found to be negligently liable in the fatal accident is essentially punished by having to pay an additional amount to any financial damages. While this seems to border upon criminal law, it is still considered a civil suit and carried out in a civil court.
