DUI Suspect Cleared in Crash that Killed Los Angeles Family

An 18 year-old, J. E. S., was recently cleared of criminal charges related to a traffic crash which killed five members of a Los Angeles family as they traveled home after an Easter weekend trip. One of the dead was a 13 year-old girl. The crash occurred in Nevada when the SUV that J. E. S. was supposedly driving rear-ended the van carrying the Los Angeles family. J. E. S. had a blood alcohol concentration (BAC) of .12 at the time of the accident. DNA and other evidence gathered by investigators, however, revealed that he could not have been the driver. Instead, his friend, who was injured in the crash and hospitalized, appears to have been the driver. Apparently, J. E. S. was intimidated by the friend into lying about the incident.
It is not known whether or not the real driver of the SUV will be arrested and charged. An investigation into the accident is still underway and the prosecutor on the case indicated that the actual driver may face felony charges. The crash occurred on March 30th of this year. An accident report states that the SUV was speeding at more than 105 mph when it crashed into the slower-moving van carrying the family. At the scene of the accident, law enforcement officers found open and unopened beer in the SUV. J.E.S. faced seven felony counts in relation to the accident and was being held on $3.5 million bail prior to being cleared. He would have been subject to two to 20 years in prison for each count.
