Driver in Fatal Injury Accident Scheduled for Court Appearance

By McCoy & McCoy  Dec. 11, 2012 11:26a

The 20-year-old driver of a car that crashed on Halloween has been charged with several serious offenses and is scheduled to appear before Superior Court in mid December. The single vehicle accident occurred in the early morning hours when witnesses say the car M.E. was driving was going down a street at "a high rate of speed". The car approached a curve in the road where the driver apparently lost control and crashed head on into a power pole at high speed. The driver and all three passengers were injured. Police and fire department personnel arrived to find a 19-year-old passenger, K.J., unconscious in the front seat. Rescue workers had to pry apart parts of the car to free K.J. from the vehicle and then rush him to the hospital. The driver and two male passengers in the back seat, ages 20 and 17, were also taken to the local hospital for treatment of non-life threatening injuries. K.J. died later on at the hospital. The police officers investigating the accident said they could smell a strong odor of alcohol coming from M.E. at the scene. The 20-year-old driver was found to have a blood alcohol concentration of 0.16 which is eight times the legal limit of .02 for individuals under the legal drinking age of 21. Did someone else's recklessness result in the loss of a loved one? Talk to a personal injury attorney to discuss a wrongful death claim.

Drunk Driver Charged with Serious Felony Offenses

M.E. and the two surviving passengers continue to recover from injuries due to the accident that claimed the life of one of their friends. M.E., however, faces additional challenges as he is asked to answer for his role in the fatal crash. He was recently charged with reckless driving, driving while intoxicated, second degree assault and second degree manslaughter. The charges could result in up to 10 years in prison if he is convicted.
