Settlement in Toyota Unintended Acceleration Case
A lawsuit against Toyota involving a woman who suffered permanent injuries due to the unintended acceleration of her Toyota Camry was recently settled. The case was settled for an undisclosed amount of damages prior to its scheduled court date which was to have occurred later this month. The plaintiff in the case, O. G. V., contended that she sustained permanent and disabling neck and back injuries when her car accelerated unexpectedly in March of 2010 while she was out running errands. She was able to slow down the car but when it accelerated again, she lost control which ended in a collision with a trailer. Among her injuries was a fractured vertebra. The lawsuit asserted that Toyota was responsible for the design flaw and for a failure to provide failsafe programming within the vehicle. O. G. V. sought both compensatory and punitive damages from the automaker.
This is one of many lawsuits Toyota has faced and will continue to face as a result of the problems with acceleration in its various models which led to a recall of over six million of its cars in 2010. In one of the initial lawsuits the company faced, it was required to pay three million dollars in damages to an injury victim as well as the family of a person who died in a car accident. In several other lawsuits concerning the unintended acceleration problem, the automaker prevailed in court.
