Seriously Injured Worker Receives Significant Damages
An electrician in New York who was seriously injured when his work truck was rear-ended received a settlement of $665,000 last October. The man, P. K., was sitting in a pickup truck owned by the company he worked for which was parked at the time when it was struck from the rear. The accident occurred in February of 2011. P. K., who had only been back to work for a few months after a previous injury, sustained shoulder, neck, and back injuries. The shoulder injury required surgery. The neck and back injuries were so severe and required so much treatment that P. K. has not been able to return to work since the accident.
P. K. sought damages from the negligent driver who rear-ended him. Unfortunately, her insurance policy only covered him for the maximum eligible amount of $50,000. After that, he sought damages on an underinsurance claim through the insurance company that covered his employer's work truck. This was done under a law which permits an injury victim to seek legal compensation through the insurer of the vehicle in which the injuries took place. This law applies in New York when the liable party's insurance is insufficient to fully cover one's damages. Through that legal route, P. K. was able to negotiate another $615,000 to more fully compensate him for his medical expenses, lost wages, loss of earning capacity, pain, and suffering.
