The Center for Justice and Democracy at New York Law School published a medical malpractice report in September 2012 entitled "Briefing Book, Medical Malpractice: By the Numbers. The report gives numerous key statistics and facts about medical malpractice and health care issues in the U.S. According to the report, not that many patients who are injured due to medical error go on to file claims or lawsuits and those that do are not considered frivolous by experts. Medical malpractice cases are dropping and are generally low in their payouts and are caused by a relatively small number of incompetent medical practitioners who are almost never disciplined or otherwise held accountable by state medical boards.
The report goes on to show that those injured patients who are successful in their claims or lawsuits against medical practitioners generally receive settlements or payouts that are much lower than is generally believed. Huge payouts are usually cut and punitive damages are uncommon. According to many studies, including one by the American Association for Justice (AAJ), preventable medical errors occur in alarming numbers throughout the nation. The AAJ has called such errors the sixth biggest killer in the United States. Many medical errors go unreported, which means that medical malpractice may be committed in even larger numbers than the prevailing statistics show.
