The CPSC is an acronym for the U.S. Consumer Product Safety Commission. As an independent government agency whose job is to regulate the manufacturing and sale of all products distributed throughout the United States. With the growing rate of injuries associated with products, the commission was created in 1972.
This organization has the authority for one can ban dangerous products from ever reaching store shelves. They also have the authority to issue recalls for products that have already been distributed. Anyone can call in and make a complaint to the CPSC so that the claim can be investigated further. If they determine that a product poses a significant risk to the safety of consumers, it will be recalled.
There are four major reasons why a product would be recalled. The first reason is for a defect in the actual manufacturing. An error in the manufacturing could directly cause a consumer to become injured. The second reason for a recall would be a design defect. This is similar to a manufacturing defect, except the negligence lies in the design itself, rather than a design mistake.
The third reason for a recall is a marketing defect. These kinds of defects are more difficult to detect. Product manufacturers must also advertise and market their product accurately so as to reveal the truth about the product. A company can be liable for negligence if they failed to warn consumers of the proper instructions for use, for example.
You can seek a claim!
The final reason the CPSC could recall a product would be because the company failed to provide a complete list of warnings associated with the product. Any of these four factors can be grounds for a liability. The CPSC's regulations are the standard by which injured consumers can seek a claim against negligence product manufacturers with the help of an injury lawyer.
