Wrongful Death Claim Filed Against Bayer CropScience

A wrongful death suit is being filed against Bayer CropScience by the mother of a West Virginia State University student that recently died. The suit claims that Portia Gray's son, Ra'Sean Gray, died as a result of exposure to substances released during an August 2008 explosion at a Bayer CropScience plant.
Ra'Sean Gray died in September 2008 after being admitted to Thomas Memorial Hospital with respiratory problems. An autopsy later revealed that Ra'Sean's death was due to a blood clot in the main artery of his lungs.
Details in the suit allege that Bayer failed to maintain reasonably safe conditions in its plant and also failed to warn the public of the release of hazardous chemicals. The suit goes on to say that the air monitors designed to trigger alarms were out of service for maintenance the day the explosion occurred.
West Virginia State University and the state Board of Education are also named as co-defendants in the wrongful death suit, with claims that they were negligent in responding to Gray's requests to have his room cleaned the night of the explosion.
