Texas Family Files Personal Injury Lawsuit after Serious Car Accident

In Texas, a family is planning to file a personal injury lawsuit after the tragic death of their son, Juan Luis Lopez.  Lopez died on December 8, 2008 after he was involved in a catastrophic car accident.  According to the family, the accident and their son's death could have been prevented if the other driver involved in the accident had not been negligent.   They are seeking damages for their pain and suffering and funeral expenses. 

News sources indicate that the accident happened at 2 AM and that, at that time, the roads were very slippery because it had been raining.  When the accident occurred, a fiery blaze erupted, which led to Lopez sustaining serious burn injuries.

The family's personal injury lawyer, Ron Rodriguez, said, "in personal injury cases, this one is one of the most severe and the most tragic.  Burn cases are extremely tragic and extremely painful."  He also reported that very little remains of the G.M.C. Lopez was driving at the time of the accident.

Lopez is reported to have been driving on I-35 when a tractor trailer heading in the opposite direction lost control due to the slick roads and crossed the median, crashing into Lopez's car, which burst into flames.  The accident led not only to Lopez's death, but also another person.

Lopez was a father to three children.  His attorney stated, "Fathers and mothers are usually central in the family and obviously the family is going through a very tragic loss."

Since the accident, Lopez's family has filed a lawsuit against Lane Line Express, who employs the tractor trailer driver.  They allege that company breached a duty owed and that the duty was established by the Texas Transportation Code which was created to protect other drivers from serious injuries.   Additionally, the family alleges that the driver acted negligently by failing to brake in a timely fashion, by speeding, and by failing to control his large motor vehicle.
