In Charleston, West Virginia, another employee has filed a personal injury lawsuit against a St. Albans crane company, All Crane and Equipment Rental Corporation. The employee, Kevin Wiggins, filed the lawsuit after he sustained serious injuries while on the job.
On September 18, Kevin Wiggins filed the lawsuit at the Kanawha Circuit Court. The lawsuit lists several defendants: All Crane and Equipment Rental Corporation, All Erection and Crane Rental Corporation and Chad Shamblin.
This marks the second lawsuit filed against the company in the past month. Previously, Shannon Jones had filed a lawsuit against the company after he was injured and crushed during a load-bearing test while working.
In Wiggins lawsuit, he claims that he sustained catastrophic injuries as a result of
falling off of a truck's broken catwalk and also as a result of non-working lights. He said that his injury occurred on September 20, 2006, and that he incurred grievous bodily injuries at that time.
After he healed from his injuries, Wiggins attempted to return to work and do light tasks. However, due to his permanent, debilitating injuries, he was unable to perform the work that was assigned to him. Shortly after, he received a call from Chad Shamblin who fired him from the company. When Wiggins called Shamblin back, Shamblin reportedly taunted and harassed the employee.
At this time, Wiggins is seeking damages for his permanent injuries, loss of wages, loss of capacity to earn income, lost enjoyment of life, pain and suffering, mental anguish and disfigurement. It has not yet been reported how much compensation Wiggins is hoping to obtain.
