CSPC Reaches Settlement With Burlilngton Coat Factory

The settlement agreement embraces the CPSC’s allegations that Burlington failed to disclose that it had caused several brands and makes of children’s clothing to be sold in the market, in gross violation of existing federal law. The articles of clothing allegedly sold were part of a crackdown initiated by the CPSC against jackets, sweatshirts and hoodies with drawstrings, specifically those made for children.
Children’s clothing with drawstrings was regulated by the government agency almost a decade ago in the wake of growing concerns and complaints from parents and civil society groups on the increased risks of entanglement and strangulation hazards.
Although not strictly construed as an open and valid admission, Burlington had allegedly sold children’s outerwear between 2008 and 2012 to its chain of distributors, involving such brands as KOMAN Sportswear, Bubblegum USA, Weeplay Kids, among several others.
The settlement was a landmark for the CPSC as the single, highest penalty imposed and collected against an erring company on issues pertaining to children’s clothing. The settlement further stipulated that Burlington may not in any manner, solicit or implore its chain of distributors, making them solely liable for failing to report inventories of recalled products.
