Just this past year a Florida man was awarded $800,000 by a jury for injuries to his arm after a fall in a local Walmart. The plaintiff had allegedly tripped over a sign and tore a tendon in a bicep that needed three surgeries to correct. Walmart claimed that the responsibility for the fall laid with the owners of the sign, in this instance Gatorade, not them. A personal injury attorney was able to prove that although the sign may not have been owned by Walmart, the fact that it was on their property made them liable.
A 49-year-old Missouri woman was also awarded by a jury for her slip and fall in a Walmart store. Once again a jury maintained that Walmart was at fault and awarded the plaintiff $275,000 in damages for an injured neck. Another Missouri woman received an $18,750 award for her leg injuries after slipping on liquid soap in a Walmart aisle. A Missouri personal injury attorney helped another slip and fall victim receive $540,000 in compensation for back injuries he sustained after slipping on dog food that was strewn in an aisle. Negligence on the side of the Walmart store was shown to be their failure to clean up the spill or barricade the area from customers. Falling merchandise in a Walmart store was the cause of another Missouri womans’ herniated disc. A jury awarded her $337,500.
A large retailer like Walmart has millions of dollars at its disposal to help them fight your personal injury claim. Their defense lawyers can argue that a dangerous condition did not exist or that there was no prior knowledge of the hazard. They may even try and claim that the injured party was negligent in their actions or caused the accident to occur themselves. It takes a skilled personal injury attorney to debunk these defenses.
Even if you do not sustain an immediate injury from an accident inside Walmart it is still a good idea to report the incident to a store manager in case you need medical attention later. Bring the manager to the spot where the accident occurred and fill out a report making sure that they write their name on it. Having this information on hand will help your personal injury attorney present your case to the defense.
Having an accident inside of a Walmart may not only be embarrassing, it may cause you some type of personal injury. If you feel like this may be the case in your situation contact a Missouri personal injury attorney to learn about your rights.
