Negligence and Wrongful Death Suit in Child Death

A three year-old child died recently after a visit to the dentist. The child, F. B., was taken to a dentist office in Kailua, Hawaii for a checkup. Her mother was told that she needed six fillings and four root canals. The child was brought back to the dentist on December 3 to have the root canals done. According to court documents, she was given five drugs to sedate and anesthetize her for the procedure. Each drug was administered as a separate dose and the little girl was not monitored for 26 minutes. The drugs caused the little girl to go into cardiac arrest. The attending dentist had to find a pediatrician in another building who could administer CPR on the child. Unfortunately, F. B. suffered brain damage that was severe and permanent. She survived for a month after the incident only due to medical life support intervention. Later, life support was removed and the child died.
The child's parents are now suing the dental office for wrongful death. An earlier negligence malpractice suit was initiated by the parents prior to F. B.'s death. According to MRIs done on the child, lack of oxygen to her brain led to the tragic results. The child's parents contend in their lawsuit that the dentist was negligent in administering the drug combination without accounting for their effects. They also contend that the dentist was unable or unprepared to handle an emergency such as the child's cardiac arrest and that leaving her alone for 26 minutes after administering the drugs was dangerous.
