Houston personal injury victims are entitled to compensation for injuries incurred as a result of medical malpractice or negligence. These legal cases arise from the negligence or malpractice of medical professionals and unfortunately can cause suffering, injury and even death for the patient. Fortunately, patients who have sustained extensive injuries as a result of medical negligence or malpractice have rights and can file a personal injury lawsuit to recover damages for: medical bills, lost wages, loss of future wages, continued medical expenses, pain, suffering and emotional trauma.
Different types of medical malpractice or negligence
- Failure to diagnose a condition or disease
- Failure to properly monitor a patient
- Surgical errors
- Anesthesia errors
- Medication errors
Statute of Limitations in Texas
A medical malpractice action must be brought about within two years from the date of injury or from the completion of treatment. In a medical malpractice lawsuit, there are two types of damages: economic and non-economic. Economic damages may consist of medical expenses or lost wages.
The state of Texas places a cap on non-economic damages, mostly for pain and suffering. The cap is $250,000 for non-economic damages. In the case of a medical malpractice wrongful death suit, damages are limited to $500,000, plus the cost of medical or custodial care.
