Are You Entitled To Workers Compensation in NC?

Workers compensation laws help employees and employers alike by providing money and medical benefits for employees who have suffered from an on-the-job injury or occupational illness. The employer benefits from workers compensation because it gives the employer immunity from any court actions that the employee may bring against the employer, in which case the question of fault or negligence is not an issue. Workers compensation functions as protection for the employee and their dependents against any current and future hardship, they may suffer as a consequence of the employee's injuries or death sustained from the workplace.

Under Chapter 97 of the Worker's Compensation Act, Article 1, the term "employment" includes employment by the State and all other political subdivisions, and all public corporations and all private employments with three or more employees with the exception of people employed in domestic services.

The term "employee" refers to each and every person who is engaged in an employment either by hire, appointment or contract, implied, oral or written, including aliens and minors, whether or not they are lawfully or unlawfully employed. However, excluding people who's employment is casual and not in the course of the trade, business or profession of his employer.

Any "employee" will not include any person who is performing a voluntary service, who receives no compensation for their services. Injury only means, an injury by accident that arose out of and in the course of employment. It may not include any form of disease, except where it results unavoidably from the workplace accident. Injuries also include damage to eyeglasses, hearing aids, dentures, or other prosthetic devices.
