Car Accident Victim Not Expected to Survive

According to Officer James Holmes, police discovered the man around 1 a.m. near 5800 W. Broadway Road. The driver of the 2009 Cadillac that allegedly hit the man is a 20-year-old woman who failed to stop because she thought she'd hit an animal or had been struck by a rock. She drove home. Once home, and with her parents, she inspected the car’s windshield. They then returned to the scene.

No Impairment

She was evaluated then. And investigators found no indications of impairment, Holmes said. No charges are currently pending.

Arizona Law

Arizona law declares you are legally obligated to stop if you are involved in an accident. Failure to stop can be considered leaving the scene of an accident. If you are considered to have left the scene of an accident you may be charged with hit and run. This charge can have serious consequences, especially if someone was injured.

Arizona law, A.R.S. 28-663 Duty to Give Information and Assistance, states if you are involved in an accident, you are legally required to perform the following duties:

  1. Give your name, address, and registration to the other driver or responding police officer.
  2. Show your driver’s license if the other driver or responding officer requests that you do so.
  3. Assist the other driver by administering first aid or getting help for injuries if necessary.

In Arizona, any individual failing to offer information or assistance after they have been involved in an accident can be charged with class-3 misdemeanor. This can come with up to $500 in fines as well as 30 days jail-time.
