Medical Malpractice Victim Awarded over $2 million in Damages

A jury recently awarded a 56-year-old man $2.1 million in a case concerning malpractice claims against a New York radiology center. The victim, M.B., had been referred to the to the radiology center by his oncologist. M.B. was suffering from a back condition which was preventing him from working as a custom cabinet maker. He was sent by his doctor to get a CT scan so that the condition could be better diagnosed. M.B. got the CT scan but the radiology center did not properly communicate to his oncologist what was found on the scan. The scan revealed that he had a spinal lesion that needed to be swiftly dealt with. The delay in getting this information to M.B.'s doctor resulted in a two week delay before vital spinal surgery was performed. During that time, he suffered a severe compression of the spinal cord. This caused permanent damage in the form of loss of sensation in both legs. Court documents stated that because of the damage to his spinal cord, M.B. suffered permanent disability and "…cannot stand or walk for any length of time and is no longer able to lift heavy materials and/or operate machinery." The jury deliberated for one day and then handed over their unanimous verdict in a case that had been tried for almost three weeks. The jury found that the radiology center was responsible for damages including pain, suffering, loss of wages and medical expenses that were not covered by the victim's health insurance. M.B.'s lawyer stated after the verdict, "Essentially the jury found that as a result of the radiology group's malpractice, [M.B.] will have to live the remainder of his life with a severe disability that has left him permanently disabled and in constant pain."
