Just four months ago a Long Beach woman was critically injured after she was hit by a vehicle while crossing in an unmarked crosswalk. According to the Press Telegram news report, the driver stopped and was not cited at that time, pending an official investigation. It was mentioned that driver inattention may have been the cause of the accident.
California
Highway Patrol Statistics
In 2008, CHP statistics showed that there were 234 injuries and six fatalities involving pedestrian accidents in the Long Beach area and almost 5,000 injuries with 214 fatalities in the Los Angeles County area for that same year.
What California Law States
According to ยง21950 of the Vehicle Code in California, the driver of a vehicle is supposed to yield the right-of-way to pedestrians who are crossing the roadway within any marked or unmarked crosswalk at an intersection. It also states that any driver who is approaching a pedestrian within any marked or unmarked crosswalk is to exercise all necessary caution and is to reduce the speed of the vehicle or take any other appropriate action to ensure the safety of the pedestrian.
Personal Injury Lawsuits
The investigation will conclude who was at fault in the above incident and if it shows that the driver was negligent, a personal injury lawsuit may well be in order. A common cause of pedestrian accidents results from driver inattention. Drivers get distracted, break traffic regulations (speeding, make unsafe turns etc.) and are sometimes under the influence of alcohol or drugs causing accident - their victims deserve compensation.
