Two city workmen using a cherry picker to hang up holiday lights were hospitalized with severe injuries recently. The men were in the bucket of the lift and had been putting up lights and other holiday decorations at the corner of Columbus Avenue and West 67th Street in the late night hours. At about 1:30 a.m., the men had finished with that corner and were lowering the basket so they could move to the next location when a UPS semi truck pulling a tractor trailer crashed into the cherry picker. The truck had been going south on Columbus when it collided with the workers and caused both men to be dumped out of the basket. They fell to the pavement below and both suffered serious head trauma and other injuries. The driver called 911 and paramedics arrived shortly thereafter. The injured workers were rushed to the hospital; both in critical condition. One of the men remains in critical condition having suffered a more extensive injury to the head than the other man. The second worker is listed as being in serious condition. Authorities are continuing to investigate the Midtown injury collision which is being called a freak accident. The driver of the UPS truck remained on the scene and cooperated with authorities. Consult with a personal injury lawyer if you were hurt in an accident that was not your fault.
Accident Victim Rights
The specifics of every accident may be different but there are factors basic to every injury accident involving negligence. When someone else—whether a driver, co-worker, product manufacturer, employer, etc.—causes injury to another person through carelessness, recklessness or a failure to uphold safety standards then he or she may be liable for all expenses and other damages suffered by the injury victim. The court requires that evidence is clearly shown which proves negligence by another party in order to award damages to the victim. You may be able to obtain compensation for pain, mental anguish, medical expenses, lost income while you are unable to work, diminished quality of life, property damage and more.
