Driving while under the influence of alcohol and/or drugs is a known cause of traffic accidents. When anyone engaging in this negligent and irresponsible behavior causes harm to others, he or she may be subject to a personal injury or wrongful death claim. According to the Governor's Office of Highway Safety in Georgia, 416 alcohol-related traffic deaths occurred in Georgia in 2008 which made up 28 percent of all traffic fatalities. The counties with the highest alcohol-related deaths were Fulton, Gwinnett, DeKalb, and Cobb.
Mothers Against Drunk Driving (MADD) reports that the number of Georgia drunk driving deaths which include a blood alcohol concentration (BAC) of .08 percent or higher in 2012 numbered 301. This number represented 25 percent of all traffic fatalities. DUI convictions in the state last year totaled 32,355. The taxpayers' subsidy of drunk driving deaths totaled about $1.47 billion.
The Century Council, which is an organization of distillers that fights drunk driving, reports that the percentage of Georgia repeat offenders involved in fatal traffic accidents in 2011 were 23 percent for those with a BAC of .08 to .14 and 77 percent for those with a BAC of .15 or more. Despite the fact that drunk driving fatalities have decreased in the state, repeat offenders with a high BAC level pose a high and dangerous threat to all Georgia drivers, car occupants, bicyclists, motorcyclists, and pedestrians.
