Recent cases involving product liability include a case in Colorado concerning Riddell, a football helmet maker and the mystery surrounding chicken jerky products leading to acute illness and death in dogs.
In the Riddell case, a jury in Colorado decided that the helmet manufacturer was at fault in the case of a 22 year-old man who suffered a head injury in 2008 while doing a football drill at school. The injury left him paralyzed on one side of his body. The jury found that Riddell had failed to provide adequate warnings to those who wear their helmets about the potential risk of concussions. The helmets were not, however, deemed to be defective. The plaintiff in the case was awarded $3.1 million in damages from the company.
In the matter of the chicken jerky products, the FDA has reported that more than 3,600 cases of illnesses and 580 deaths of dogs have occurred in association with being fed these products. The illnesses include gastrointestinal problems, kidney problems, convulsions, tremors, and skin problems which affect all breeds of dogs. The FDA has been investigating but as yet has not been able to determine what ingredient in the products is the cause.
