A prisoner at the Twin Falls County Jail has filed a personal injury lawsuit against the five jailers that left him permanently injured following a brutal attack, allegedly inflicted on him because he had spurned the advances of one of his guards, as reported by the Courthouse News Service.
K.G., 24, has claimed in court that since the beating he now suffers with brain damage.
K.G. is a first time offender, and was serving a 180-day sentence for misdemeanor DUI at the time of the attack.
The five jailers named in the suit are A.H., B.T., S.T., J.H. and J.A. Twin Falls County is also named as a defendant in the lawsuit.
S.T. is named specifically for forcing K.G. to be strip searched prior to the beating. S.T. allegedly told K.G. that he had a "nice body", he "should consider pursuing a career in homosexual pornography" and he could "get any guy he wanted."
S.T. allegedly made other sexual comments to K.G. In those instances, according to the suit, K.G. reported it to the officials in the Twin County Jail. He also reported, specifically to jailer A.H., that other inmates threatened to sexually assault him on January 29.
A.H. allegedly removed K.G. from his cell during a routine check. Once A.H. had K.G. in the corridor he attacked him by grabbing the back of his collar and slamming him into the ground. The impact of the fall caused K.G. to hit his head on the hard surface and break his eyeglasses.
During the beating A.H. was joined by B.T., S.T. and J.H. According to the suit the guards began to strike "him in the face and using a series of military-style, hand-to-hand combat, pain-infliction techniques. Mr. (B.T.) struck (K.G.) in the head and face with a closed fist approximately six times, inflicting extreme pain and serious bodily injuries on (K.G.)."
The suit alleges that during the beating K.G. overheard B.T. say, "Oh wow, I can't believe he's still conscious." K.G. further stated that his nose, a shoulder and a knee may have received permanent damage, and his brain injuries have since caused him to suffer with "memory loss, cognitive delay, inability to concentrate and neurological impairments."
Following the attack K.G. was left on the floor of a cell with "numerous large contusions on his head and face."
K.G., though unconfirmed, believes that the attack was a result of spurning B.T.'s sexual advances.
Audio and video surveillance, according to K.G., were either destroyed or simply "not preserved."
K.G.'s eyeglasses were returned 10 days after the beating and he was denied medical care until he agreed to "misrepresent" how he got his injuries. His family finally obtained a court order making sure that K.G. receive medical care.
K.G. is seeking damages for the violation of his civil rights, negligence and spoliation of evidence.
