Benjamin Barbour of York County now faces two counts of vehicular homicide for his role in a fatal drunk driving accident.
According to the attorney for the victim's family, Barbour had a blood-alcohol content of .24 when he struck Ronald and Peggy Eaton on their motorcycle. This is twice the state legal limit. The accident happened in August 2009 when Barbour turned in front of the Eatons while driving on Furnace Road. Police reports from that day clearly show that Barbour failed multiple field sobriety tests. The responding officers could also smell alcohol strongly coming off of his person.
Since this is Barbour's second DUI Eaton's brother, Robert Eaton, has decided to file a civil lawsuit. He told the press this week that "My understanding is that he was convicted of DUI once and didn't learn his lesson." As a result of his negligence a son and grandson have been left behind. Barbour's next court appearance is March 25.
