Parents File Wrongful Death Claim Against Pest Control Company

After losing both their daughters to a poison utilized by the local pest control company, Brenda and Nathan Toone decided to take legal action. This week they filed a wrongful death lawsuit in the 2nd District Court against Bugman Pest and Lawn company, as well as employee Coleman Nocks.
Last year Nocks visited their home on Feb. 5, 2010 when he applied Fumitoxin, a pesticide designed to kill field mice. Yet when their daughters, Rebecca, 4, and Rachel, 15 months, as well as two more children and Nathan became ill, they knew that something was wrong. The two girls died four days later when their hearts shut down.
The family is now suing for damages for negligent infliction of emotional distress, negligence, abnormally dangerous activity and nuisance. They are represented by Peter Summerill who commented that, "The Toone family intends to see that those responsible for this tragedy are held fully accountable, both within the criminal- and civil-justice system."
