Drunk Driver Only Serves Months in Jail after 6th DWI

In North Carolina a man convicted of his sixth DWI only served 9 months out of a two year sentence due to a loop hole in the structured sentencing law. This states that someone who has been previously convicted of a DWI will only serve half of his sentence once he is sent to jail; this time can be whittled down even further through "gain time," "merit time" and "good time". This law has been in effect in North Carolina since 1994.
However, this same man has now been charged with not only another DWI but second-degree murder as well following an accident that killed Daniel Herring in Monroe. Other charges have also been added to the list of offenses against Kevin O'Hagan, the man responsible for Herring's death. He is now being held on a $500,000 bond in the Union County Jail.
