DUI Offender Kills Pedestrian in San Diego

In San Diego, it is reported that a 45 year old man by the name of Alan Lester Mabrey stands accused of driving under the influence and hitting a pedestrian in Pacific Beach. Ironically, a year before the accident, law enforcement had warned Mabrey that if he did not stop drinking and driving, he would kill someone.
The accident occurred in February of 2009. According to police, Mabrey was only in San Diego for a few days before hitting 24 year old Emily Dowdy, who worked at a local Starbucks. On February 27th, Dowdy was hit by Mabrey as she walked across Mission Boulevard. The very next day, she died from her catastrophic injuries.
This week Monday, Mabrey's trial commenced and evidence was presented. He is currently facing conviction for second-degree murder, gross vehicular manslaughter while intoxicated, hit and run and also driving under the influence. If he is convicted, he will have to serve years in prison.
While giving opening statements, the lead prosecutor revealed that following the accident, Mabrey fled. He returned to the scene approximately an hour later after eating at a nearby Burger King. When police arrived, Mabrey submitted to a breath alcohol test, which revealed his blood alcohol concentration was .22 percent. In the state of California, the legal limit is 0.08%.
