The fathers of a San Antonio couple that was killed in a bicycle accident have filed a wrongful death lawsuit against the driver responsible for the accident.
Gary Bruehler and Forrest Telleson, fathers of Gregory Bruehler and Alexandra Bruehler, are suing Gilbert John Sullaway, Jr. and Advanced Detection Security Inc., Sullaway's business.
The lawsuit has been filed on behalf of Gregory and Alexandra's 7-year-old daughter Kylie.
The Bruehlers were killed when Sullaway struck their tandem bicycle after overcorrecting when he veered off the road.
Gary Bruehler said he, along with Telleson, filed the lawsuit to ensure their granddaughter had the financial support she needed to at least get through college.
Although the police have reported the incident as an accident, Bruehler believes there must have been some negligence involved.
"We can assume [Sullaway] was distracted by something in the car or a cell phone, or he wouldn't have gone off the road twice before he hit the kids."
Bruehler and Telleson are seeking damages for medical and funeral expenses, as well as compensation for loss of companionship, mental anguish, and for the Bruehlers' "pre-death pain, suffering, and mental anguish."
At this time, no citations or criminal charges have been filed against Sullaway, and the District Attorney's Office said they have not received any cases from the Sheriff's Office. According to the Sheriff's Office, Sullaway was not intoxicated or speeding excessively.
