Woman Sues Yamaha for Injuries Suffered in Rhino Rollover Accident

A Texas woman has filed a lawsuit against Yamaha Motor Corporation for injuries she allegedly suffered while riding one of the company's popular all-terrain vehicles (ATVs). 

Krissi Henry claims that Yamaha Motor Corporation, in addition to Yamaha Manufacturing and Yamaha Motor Company, marketed a product that was dangerously defective and unfit for riders.

According to the lawsuit, Henry suffered an injury to her right leg when the ATV rolled over toward the passenger side as the vehicle was being driven on flat terrain.  Henry claims the narrow wheel base and high center of gravity contributed to the accident.

Henry and her husband Jason, who filed the lawsuit together, allege that Yamaha and its affiliates failed to properly warn riders of the vehicle's dangers, and did not provide adequate safety operating instructions.  The Henrys also claim Yamaha violated strict liability, negligence, and breaches of warranties in marketing the Rhinos.

The Henrys are seeking damages for healthcare expenses, physical pain and suffering, mental anguish, physical disability and impairment, disfigurement, lost wages, loss of wage earning capacity, loss of consortium, loss of household services, and pre and post-judgment interest.

Yamaha and its affiliates have been the subject of thousands of personal injury lawsuits across the country, filed by people claiming to have suffered an injury or death while riding the vehicle. Numerous product safety recalls have also been issued since the Rhinos were first sold in 2003.
