Moneesha Henley of Illinois has filed a lawsuit against Joyce Dave, also of Illinois, claiming that Dave lost control of her vehicle, causing her to collide with Henley in a
car accident that led to Henley's injury.
According to the complaint that was filed with the court, Henley claimed that she was heading east when Dave, who was driving west, lost control of her vehicle and collided with Henley.
Henley claims that as a result of the accident she has suffered injuries on numerous parts of her body, as well as to her nervous system. She is seeking a judgment in excess of $50,000 in damages for substantial medical expenses, lost substantial wages, damaged earning capacity, and limitations that directly limit her ability to enjoy life.
In order to recover damages in an auto accident lawsuit, you must prove that the other party acted negligently. Henley is claiming Dave's was negligent by failing to reduce her speed, failing to keep an appropriate lookout, failing to keep her vehicle under control, failing to keep her vehicle on the right-hand side of the road, and by driving across the center of the roadway.
