Boston Family Wins $28 Million in Wrongful Death Lawsuit

StarTribune.com is reporting that a Boston family just won a $28 million wrongful death lawsuit.  The family of the woman killed filed the lawsuit because the woman died when a Big Dig tunnel ceiling collapsed.

On Tuesday, the attorney representing the family announced that the lawsuit had been settled.  The attorney was representing the deceased woman's husband and three young children.  According to reports, the woman, Milena Del Valle, died in July 2006 when the 26 ton ceiling of a tunnel caved in on top of her car.

The lawsuit listed companies that worked on the Big Dig as defendants such as Bechtel/Parsons Brinkerhoff, Modern Continental Co., Gannett Fleming Inc. and the Massachusetts Turnpike Authority. 

The family's attorney, Brad Henry, reported that the family resolved all claims against the 15 defendants and that Powers Fasteners Inc. would be paying a large settlement of $6 million.

According to StarTribune.com, "The National Transportation Safety Board said in a 2007 report that the wrong type of epoxy was used. The report spread blame among Big Dig project manager Bechtel/Parsons Brinckerhoff, construction contractor Modern Continental, designer Gannett Fleming and Powers Fasteners, the firm that supplied the epoxy.  Gannett Fleming and BPP were criticized for failing to identify potential creep in the epoxy bolts. Modern Continental and BPP were faulted for failing to monitor the bolts after several of them began to creep out of the ceiling in 1999."
