With the warm weather around the corner, people of all ages will be swimming in pools across the nation. As we all know, swimming pools are in both private and public settings; for example, pools can be at hotels, apartment buildings, recreation center pools, country clubs, high schools, and in backyards.

If someone is injured or killed in a swimming pool accident, does the victim or their surviving family members have the right to pursue damages? In many cases, yes absolutely.

Lawsuits Against the Owner of the Pool

Swimming pools are inherently dangerous; therefore, pool owners must take all reasonable precautions to ensure that the pool is safe for all invited and uninvited guests –namely children – who could be injured while the pool owner is elsewhere.

If a child is injured in a pool or drowning accident while under the supervision of a school or daycare, or other organization such as a summer camp that is responsible for watching the child, the parents should be able to file a lawsuit against that party.

Organizations that watch children have a duty to care for those children and protect them. If a child is injured while under a company's protection, then a lawsuit is usually in order.
