Woman Settles Lawsuit with City for Hip Fracture She Sustained at District Courthouse

April 23, 2014, a Michigan woman reached a $75,000 settlement with the Warren City in the personal injury lawsuit she filed over a hip fracture and other injuries she sustained at the 37th District Court in Warren. According to her personal injury lawsuit, the 45-year-old woman was in court back in 2012 to handle a landlord-tenant issue. Her right leg had been amputated at the knee the year before, so she was on crutches. She decided to use the elevator instead of the stairs to get to the basement.
She and her roommate travelled down just fine, but upon exiting, the elevator door is said to have shut on her, hitting her at the hip and trapping her there. She said her hip was broken as a result. As she was being helped, the plaintiff said she heard a person mention how that door had known problems and that it had only been a matter of time before someone got hurt. Her lawyer argued that there should have been an "electronic eye" that would prevent this type of accident. The woman had to have surgery and considerable rehabilitation. She sued for her physical and emotional suffering as well as her medical costs.
Slip and fall accidents are not the only premises liability claims that can be filed. Property owners, even cities themselves, can be held liable for a good deal of injuries that resulted from improper upkeep of the premises.
