Understanding Defective Cars and Auto Recalls
Posted on Jul 24, 2013 4:44pm PDT
The number of defective cars out on the market today is frightening to think of. Whether it is the unintended acceleration which is claiming he lives of a number of victims because they are not able to control their car at all, or it is the placement of the fuel tank which is leading to dangerous fires and explosions in the vehicle. The list of possibilities in defective auto parts goes on to brake problems, air bag defects, and seat belt problems. All of which are leading to car recalls in order to prevent further tragic accidents, and potentially save the lives of people on the road. While the recalls are a measure to save lives, sadly sometimes it takes accidents and injuries or death before action is taken. Either way, if you or a love don is injured or killed in a car accident caused by a defective auto part, do not hesitate in contacting an experienced personal injury attorney in your area to take legal action.
According to reports, every year there are an estimated 42,000 deaths that are caused on the roads as a result of some sort of defective auto part. Sadly, even those who survive these sorts of accidents are often left to suffer for the remainder of their lives. For example, in the United States, one of the leading causes that leads to paraplegia (or loss of feeling from the waist down) is due to traffic accidents, as well as the leading killer for Americans who are younger than 34 years of age. Annually, over $150 billion is spent on costs for auto accidents including workers wages, insurance, medical bills, etc. As a result of this, the government seeks to do whatever they can in order to prevent more accidents from occurring. In order to do this, when a car is found to be defective, they will conduct a recall, in order to pull off the bad products from the market and from the driveways and garages of potential victims. According to the National Highway Traffic Safety Administration, there have been over 299 million vehicles (trucks, cars, motorcycles, buses, recreational vehicles) pulled off the market in order to protect the public. Another 43 million tires have been recalled as well as 84 million different types of equipment that belong in the vehicles like an infant car seat.
Recalls are necessary according to the Federal motor Vehicle Safety Standards are not met in a certain way. These standards require that there be a bar of minimum performance that must never be passed. Generally these standards are geared towards the more primary parts of a vehicle such as the tires, braked, lighting, etc. or anything else that is used and required to protect the passengers from harm in the event of an actual accident. This would include seat belts, steering columns in the car, and helmets for motorcycles, air bags and the like. When a recall is administered it applies to all cars they are made and imported in the country. Even if it was made in Japan, for example, the government here has the right to recall the car for defective reasons. The recall will be deemed necessary by the federal regulators if the motor vehicle or item of the motor vehicle does not meet the standards set by the government or there is a known defect in the vehicle itself or the equipment that is safety related. If any of these occur, a recall will occur for the safety of the public.
Unfortunately, people are still injured or killed in accidents due to defective products. If you have lost a loved one, please contact a personal injury attorney in your area to discuss your case immediately!
