Driver distraction is a major cause of auto accidents and can come in many forms, but one of the most common is the use of cell phones. Talking and texting on cell phones while driving has become a major hazard and many states are banning this activity to cut down on accidents and lost lives.
Some Statistics on Texting
In a NY Times article, some statistics were reported from a survey done and it was determined that when individuals text while driving, it increase their risk of having an accident by 23 times. In the survey, 95% of the drivers surveyed agreed that texting while driving was not acceptable behavior although 21 % of them admitted to having recently done it. 50% of the drivers that were ages 16-24 said they text while driving as compared to 22% of drivers who were ages 35 to 44.
Cell Phone Confiscation for Evidence
If you have been injured in a car or other vehicle accident in the Tampa area, and you suspect that the other driver may have been distracted by a cell phone, here is a wise move you can make. You should out rightly claim that you think this may have happened and accuse the other driver of such. This will most likely prompt the police to confiscate the cell phone for evidence and this can be used to your advantage in a personal injury lawsuit. If they don't confiscate it, ask them to do so. This one action may provide the evidence necessary to prove the other drivers fault in causing the accident.
