Under Oregon law, a wrongful death claim must be initiated on behalf of surviving family members within three years after the death occurred. A wrongful death is one which is caused by the negligence, recklessness, or deliberate misconduct of another or others. In Oregon, the wrongful death claim is brought by the deceased person's personal representative for his estate; it is initiated on behalf of the surviving spouse, children, or parents. Stepchildren or stepparents may also be eligible to receive damages in some cases. Wrongful deaths are often the result of traffic accidents but may be caused in other types of accidents and incidents as well.
Damages and losses which may be recovered for beneficiaries in a wrongful death claim include the medical expenses incurred before the death, funeral and burial expenses, wages and income lost due to the person's death, including future income that he or she may have earned and other financial losses, such as pensions, medical insurance, and other benefits. Other damages may include non-economic damages, which are capped at $500,000 in Oregon. These damages include those relating to the loss of companionship, society, and services that the deceased provided to family members. In some cases, punitive damages may also be recovered in cases where extreme recklessness or aggravated conduct caused the death.
